Terms of Service

These Terms of Service ("Terms") govern your use of Citybrk (the "App"), published by Citybrk ("we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms. If you don't agree, don't use the App.

1. What Citybrk is

Citybrk is a local-only photo organization app for iOS and Android. It reads the photo and video library already on your device and organizes it into trips, cities, and countries, entirely on-device. See the Privacy Policy for details on how the App handles your data (in short: it doesn't send any of it anywhere).

2. License to use the App

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Citybrk on devices you own or control, for your own personal, non-commercial use, subject to these Terms. You may not:

• Reverse-engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits this despite the restriction.
• Redistribute, sell, rent, lease, or sublicense the App.
• Use the App in any way that violates applicable law.

3. Your content

Citybrk reads photos and videos that already exist in your device's library. You retain full ownership of, and responsibility for, that content. Citybrk never copies, uploads, or transmits it anywhere — it stays under your control on your device at all times. Because the App does not receive or store your media anywhere off-device, we have no ability to recover it if it's lost, and you're responsible for backing up your own photo library through whatever means you normally use (e.g. your device's own cloud backup).

4. Free app, no purchases

Citybrk is currently free to download and use, with no advertisements, in-app purchases, or subscriptions. If that ever changes, we'll update these Terms and the relevant store listing before any paid feature ships, and nothing you've already unlocked for free will be taken away retroactively.

5. No warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the App will be uninterrupted, error-free, or that trip/city detection will always be accurate — offline geocoding and clustering are best-effort and may occasionally group photos incorrectly or miss a location.

6. Limitation of liability

To the maximum extent permitted by applicable law, Citybrk and its publisher will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App — even if advised of the possibility of such damages. Because Citybrk never transmits or stores your photos off your device, we are never in possession of your media and cannot be held responsible for its loss, corruption, or unavailability.

7. Changes to the App and these Terms

We may update the App and these Terms from time to time. If we make material changes to these Terms, we'll update the "Last updated" date above. Continuing to use the App after changes take effect means you accept the revised Terms.

8. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your license to use the App if you violate these Terms.

9. Governing law

These Terms are governed by the laws of the jurisdiction in which the publisher operates, without regard to conflict-of-law principles, except where local consumer-protection law grants you additional rights that cannot be waived.
